By using or accessing the website of Green Eye Tactical, LLC (the “Site”), you agree to adhere to the following Terms of Use (“TOU”) set forth by Green Eye Tactical, LLC (“We” or “Us”). You must be 18 years of age or older to register an account with Us.
By registering a user profile on the Site, you agree to the following terms of this TOU. We reserve the right to change the TOU at any time. By continuing to use the Site you agree to be bound by the most updated version of the TOU. The most current version of the TOU can be viewed by clicking the “Terms of Use” link at the bottom of the Site.
If you register an account with the Site, you must complete the registration process by providing Us with accurate information as required by the registration form. You recognize that We may ask you to input information such as your first and last name, your shipping address, your phone number, and your email address. You are entirely responsible for maintaining the confidentiality of your password and account. You agree to notify Us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.
You acknowledge that public computers are not considered to be secure, and that the use of the Site and its related services on a public computer may adversely impact the confidentiality and security of your account and personal data.
You agree that you will not use the Site for any purpose that is unlawful or prohibited by our TOU. You may not use the Site in any manner that could damage, disable, overburden, or impair any of our servers or any affiliated networks.
Do not interfere with any other party’s use and enjoyment of the Site. Do not attempt to gain unauthorized access to any accounts, systems, or related databases through hacking, password mining, or by any other means. You will not obtain or access any materials or information through any means not intentionally permitted by Us.
Do not use the Site in connection with pyramid schemes, chain letters, junk email, spamming, or any duplicative or unsolicited messages (commercial or otherwise).
Do not provide any comments that are defamatory, abusive, illegal, infringing, or otherwise tortious. You will not post, publish, distribute, or disseminate any inappropriate, profane, defamatory, obscene, indecent, or unlawful names, material, information, comments, stories, pictures, abusive rants, negativity, or slander against other users. You will not defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Do not attempt to transmit files or post hyperlinks that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another.
Do not download any file posted by another user that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
Do not gather information from the Site, either manually or on an automated basis. Do not use any information from the Site for third-party or commercial use.
Do not encourage any violations of our TOU.
We reserve the right to delete your account and refuse service if you are found to be in violation of this TOU and any other of our policies.
If anyone brings a claim against Us in relation to your actions, you will indemnify and hold Us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Please see the Indemnification section for more information.
Unless otherwise specified, the Site is provided for your personal and non-commercial use. Do not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information from the Site.
By using the Site, you represent and warrant that you are using it for solely personal use. You further represent and warrant and that you are not an attorney or an agent of an attorney conducting an investigation for a potential claim related to Us.
We do not regularly review our webpages.
Links posted on webpages within the Site may lead you to a third-party website. These linked websites are not under our control, and we are not responsible for the contents of any linked website. We do not monitor the third-party links listed on webpages within the Site nor do we endorse them.
If you choose to link or login to third-party social media websites via the Site (e.g., Twitter, Facebook) you grant Us permission to access and publish the content from those profiles on the Site.
You recognize that the Site may deliver content from advertising sponsors.
We care about your privacy. Refer to Our Privacy Policy for further information. By agreeing to this TOU, you agree to adhere to the Privacy Policy and all amendments thereto.
We provide our services and sales in compliance with ITAR, and all delivery of services and goods will be contingent on such compliance. We reserve the right to withhold or cancel any sale should We have reason to believe, whether that belief is accurate or not, that completion thereof would not comply with our obligations under ITAR.
Our pricing represents a comparative price estimate and may/may not represent the prevailing price in any area on any particular day. We cannot confirm the price of an item until you order. Minimum prices are subject to change. Despite our best efforts, items may sometimes be mispriced. If there are any issues, please contact Us and we will work with you in an attempt to correct discrepancies.
We do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. If you believe that a product description is inaccurate, your sole remedy is to return it in unused condition. We do offer returns or refunds for courses.
All items purchased from Us are made pursuant to a shipment contract. Risk of loss and title for such items pass to you upon our delivery to the carrier. No returns or refunds are available for courses.
The Site is protected by United States copyright law, United States trade secret law, United States trademark law, and by international treaty provisions. Do not remove any proprietary notice of Green Eye Tactical, LLC. All webpages made available to you on the Site are the copyrighted work of Green Eye Tactical, LLC. All rights are reserved.
The illegal use of any material on the Site in a manner that infringes the copyright, trademark, patent, trade secret, or other proprietary right of any party is prohibited. Trademarks appearing on the Site are the property of their respective owners.
Communications from us to the user will be sent via electronic mail. You agree that this satisfies any legal requirement of “in writing” from Us to you.
We provide a monitored and active email address for you to report abuse. If you believe any content on the Site is against the TOU, please contact Us.
No redistribution, retransmission, publication, or commercial exploitation of downloadable material is permitted without the express written approval of Green Eye Tactical, LLC or the respective copyright owner.

In no event will We be liable to you or any third-party for any lost profits or revenue, incidental or consequential damages (including, without limitation, indirect, special, punitive, or exemplary damages) arising out of the use or inability to use the Services or the Site, or for any claim by any other party, even if We have been advised of, had (or should have had) any knowledge (actual or constructive) of the possibility of such damages. We are not liable for the effects of any service outages, breach of servers (server or client side), or the resulting effects of such occurrences. Our aggregate liability with respect to its obligations under this agreement or its Privacy Policy, or with respect to the services or otherwise, will not exceed the amount of the fee paid for the services. Some jurisdictions do not allow the exclusion or waiver of limitation of liability for consequential or incidental damages, so they may not apply to you.
You agree specifically that this limitation will not limit any liability for gross negligence, intentional tortious behavior, unlawful conduct, or damages for strict liability that may not be limited by law.
All services are provided “as is.” Any use of our services and the Site is at your own risk. We do not warrant that any services will work properly or continuously. To the maximum extent permitted by law, We disclaim all warranties of any kind, either expressed or implied, either in fact or by operation of law, statutory or otherwise, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and warranty of non-infringement. We do not warrant that the services provided will meet any requirements or needs you may have, that the services will operate error-free or in an uninterrupted fashion, that any defects or errors in the product will be corrected, or that the services are compatible with any particular platform.
You agree to defend, indemnify, and hold harmless Us, our officers, and our employees, against any and all third-party claims, suits, costs, losses, liabilities, and expenses of any kind (including reasonable attorneys’ fees) that may incur, arise out of, or result from your use of the Site or from your breach of this TOU or privacy policy.
This agreement will be construed, interpreted, and governed in accordance with the laws of the State of Texas without application of choice-of-law provisions that would require the application of the laws of another jurisdiction. By accepting this agreement, all parties irrevocably submit themselves to the exclusive personal jurisdiction and venue of the state and federal courts of Collin County, Texas, with regard to any dispute between them, arising under, or relating to this agreement. The parties also hereby waive any venue or personal jurisdiction challenge they may have to a lawsuit relating to or arising under this agreement that has been filed in a state or federal court in Collin County, Texas.
This constitutes the entire agreement and supersedes any other agreements (oral or written). We may amend our policies at any time. If you do not accept our terms at any time, you agree to terminate your account.
This agreement does not create any agency, partnership, joint venture, employment, or franchise relationship. If any part of this agreement is found to be invalid or unenforceable, the remainder of the agreement will not be affected.
Our failure to enforce any rights granted in the TOU does not constitute waiver as to the subsequent enforcement of rights or actions reserved by Us.
